Terms of Service

1. Acceptance of Terms
By accessing or using the Government Contracts Hub platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree, you must not use the Service.
These Terms constitute a binding legal agreement between you (or the organisation you represent) and Government Contracts Hub ("Government Contracts Hub", "we", "us"). If you accept these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Description of Service
Government Contracts Hub aggregates and indexes publicly available government procurement notices, tenders, and contract awards from federal, provincial/state, and municipal sources across Canada, the United States, and the United Kingdom. The Service provides search, filtering, alerting, and analytics tools to help businesses identify public-sector procurement opportunities.
Government Contracts Hub does not act as a procurement agent, broker, or intermediary. We do not submit bids or proposals on your behalf. All procurement activity is conducted directly between you and the relevant government entity.
3. Eligibility
The Service is intended for use by legal entities and individuals who are at least 18 years of age. By creating an account, you represent that: (a) you are 18 or older; (b) you have the legal capacity to enter into these Terms; and (c) your use of the Service does not violate any applicable laws.
We do not knowingly collect or solicit information from anyone under 13. If we learn we have inadvertently collected personal data from a minor, we will delete it promptly.
4. Account Registration and Security
You must provide accurate, complete, and current information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at Governmentcontractshub.Contact@gmail.com of any unauthorized access or suspected security breach.
We reserve the right to suspend or terminate accounts that we have reasonable grounds to believe have been compromised or are being used fraudulently. Sharing account credentials is prohibited unless your subscription plan expressly permits multi-seat access.
5. Subscription Plans and Payment
The Service offers a free tier and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis through our payment processor (Stripe). All prices are in Canadian Dollars (CAD) unless otherwise stated.
Cancellation and refunds: You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods unless required by applicable consumer protection law in your jurisdiction (including the Consumer Protection Act, 2002 (Ontario) or the Consumer Protection Act (Quebec)).
We reserve the right to change pricing with 30 days' written notice. Your continued use after the effective date of a price change constitutes acceptance.
6. Acceptable Use
You agree not to:
- Scrape, crawl, or systematically download data from the Service except through our authorised API or data export features
- Attempt to circumvent any access controls, rate limits, or authentication mechanisms
- Resell, sublicense, or redistribute Government Contracts Hub data to third parties without a written data reseller agreement
- Use the Service to build a competing product or benchmarking service
- Upload, transmit, or store malicious code, viruses, or any content that infringes third-party intellectual property rights
- Use the Service in violation of any applicable law, including spam legislation (CASL, CAN-SPAM, PECR)
- Interfere with or disrupt the integrity or performance of the Service
7. Intellectual Property
All software, algorithms, UI/UX design, trademarks, and proprietary methodologies embodied in the Service are owned by or licensed to Government Contracts Hub and are protected under the copyright laws of Canada, the United States, the United Kingdom, and applicable international treaties.
Underlying public data: Tender notices, contract awards, and other procurement records sourced from government portals remain the property of the issuing government authority. Government Contracts Hub claims no ownership over the underlying factual content of public procurement notices.
You retain ownership of any content or data you submit to the Service (e.g., saved searches, company profiles). By submitting such content, you grant Government Contracts Hub a non-exclusive, royalty-free licence to use it solely to provide and improve the Service.
8. Data Accuracy and Disclaimer
Government Contracts Hub strives to provide accurate, up-to-date procurement information; however, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted access.
Government portals may update or remove notices without notice. Government Contracts Hub cannot guarantee that the Service reflects real-time changes to source data. You are responsible for verifying the accuracy and completeness of any procurement information before relying on it for business decisions.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Government Contracts Hub and its directors, employees, agents, licensors, and service providers shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business opportunities, or goodwill
- Damages arising from missed procurement opportunities or inaccurate data
- Any damages exceeding the total fees paid by you to Government Contracts Hub in the three (3) months preceding the claim
Some jurisdictions do not allow the exclusion or limitation of certain warranties or consequential damages; in such cases, the above limitations apply to the fullest extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Government Contracts Hub and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms; (b) your use of the Service; or (c) any content you submit to the Service.
11. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, incorporated herein by reference. We process personal data in accordance with applicable privacy laws, including:
- Canada: the Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec's Law 25 (Act to modernise legislative provisions as regards the protection of personal information)
- United Kingdom: the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018
- United States (California): the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA)

12. Electronic Communications and CASL / CAN-SPAM / PECR
By creating an account, you consent to receiving transactional emails (e.g., account confirmations, security alerts, invoice receipts). Marketing communications are subject to a separate opt-in consent.
We comply with Canada's Anti-Spam Legislation (CASL), the United States CAN-SPAM Act, and the UK Privacy and Electronic Communications Regulations (PECR). You may withdraw consent to marketing emails at any time by clicking the unsubscribe link in any marketing email or by emailing Governmentcontractshub.Contact@gmail.com.
13. Third-Party Services
The Service integrates with third-party providers including payment processors, email delivery services, and cloud infrastructure providers. These providers are subject to their own terms and privacy policies. Government Contracts Hub is not responsible for the acts or omissions of third-party service providers.
14. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue all or any part of the Service at any time with reasonable notice where practical. We will provide at least 30 days' notice before discontinuing a paid feature. We are not liable for any loss or damage caused by planned or unplanned service interruptions.
15. Termination
Either party may terminate this agreement at any time. Government Contracts Hub may suspend or terminate your access immediately and without notice if: (a) you breach these Terms; (b) we are required to do so by law; or (c) we have reasonable grounds to believe your account poses a security risk.
Upon termination, your right to use the Service ceases. Provisions of these Terms that by their nature should survive (Sections 7, 9, 10, 16, 17) will survive termination.
16. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
Dispute resolution: The parties agree to attempt in good faith to resolve any dispute through informal negotiation for 30 days before commencing formal proceedings. If unresolved, disputes shall be submitted to binding arbitration in Montreal, Quebec, under the Code of Civil Procedure (Quebec).
UK users: Nothing in these Terms limits your rights under UK consumer protection law, including your right to bring a claim in the courts of England and Wales or Scotland.
US users: To the extent required by applicable state law, you retain the right to bring individual claims in small claims court.
17. General Provisions
Entire agreement: These Terms, together with the Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and Government Contracts Hub.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
Waiver: Our failure to enforce any provision of these Terms is not a waiver of that provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor entity.
Force majeure: Neither party is liable for delays or failures caused by circumstances beyond its reasonable control.
18. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
If you do not agree to the updated Terms, you may cancel your account before they take effect.
